Terms of Service

The terms that govern use of the DevAcademia platform and services.

These Terms of Service ("Terms") govern access to and use of the DevAcademia platform, website, and related services (the "Service"). By using the Service you agree to these Terms.

About this document. These Terms describe how the
DevAcademia platform may be used. They are a living document,
reviewed periodically and updated as our services and applicable
law evolve. Where an institution has a subscription agreement
with DevAcademia — including a Data Processing Agreement — that
agreement governs where it differs from these Terms.

#1. Who may use the Service

The Service is provided to educational institutions and to the educators and learners those institutions authorise. If you use the Service through an institution, your use is also subject to that institution's policies. If you are using the Service on behalf of an institution, you represent that you are authorised to bind that institution to these Terms.

You must be old enough to use the Service under the laws that apply to you. Where students are minors, the institution is responsible for the consents described in our Privacy Policy.


#2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly of any unauthorised use. Institutions are responsible for managing their members' access and roles.


#3. Acceptable use

You agree not to:

  • Use the Service in violation of any law or third-party right.
  • Attempt to gain unauthorised access to the Service, other

accounts, or the underlying systems.

  • Interfere with or disrupt the integrity or performance of the

Service.

  • Reverse-engineer, scrape, or copy the Service except as

permitted by law.

  • Upload malicious code or content that is unlawful, infringing, or

harmful.

  • Use the Service to build a competing product.

We may suspend access to protect the Service, its users, or institution data where use violates these Terms.


#4. Institution data and privacy

Personal data processed through the Service is handled as described in our Privacy Policy and, for institutions, under the Data Processing Agreement. As between DevAcademia and an institution, the institution owns and controls its education records; DevAcademia processes them only to provide the Service and on the institution's instructions. Retention and deletion follow the data retention schedule.


#5. Your content

You (or your institution) retain ownership of the content you submit to the Service. You grant DevAcademia the limited licence needed to host, process, and display that content for the purpose of providing the Service, and for no other purpose. DevAcademia does not use institution or student content for advertising or to train external AI models.


#6. Intellectual property

The Service, including its software, design, and content provided by DevAcademia, is owned by DevAcademia and its licensors and is protected by intellectual-property law. These Terms do not grant you any right in DevAcademia's intellectual property except the limited right to use the Service as permitted.


#7. Availability and support

DevAcademia works to keep the Service available and secure, and provides support as described in the applicable subscription agreement. Planned maintenance and service levels, where offered, are set out in that agreement.


#8. Third-party services

The Service relies on the sub-processors named in our sub-processor list and may integrate with third-party destinations an institution configures. Those third parties are governed by their own terms; DevAcademia is not responsible for third-party services outside its control.


#9. Disclaimers

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. Any specific service warranties DevAcademia offers are those set out in the applicable subscription agreement between DevAcademia and the institution.


#10. Limitation of liability

To the fullest extent permitted by applicable law, DevAcademia is not liable for indirect, incidental, or consequential damages arising from use of the Service. Any agreed limits on DevAcademia's liability are those set out in the applicable subscription agreement between DevAcademia and the institution.


#11. Indemnification

Responsibility for third-party claims arising from use of the Service is allocated in the applicable subscription agreement between DevAcademia and the institution.


#12. Termination

Either party may terminate use of the Service as set out in the applicable subscription agreement. On termination, DevAcademia returns and deletes institution data on the timeline in the data retention schedule. Provisions that by their nature should survive termination (ownership, disclaimers, limitations of liability) survive.


#13. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. Material changes are communicated in advance where required by the applicable agreement or by law. Continued use after a change takes effect constitutes acceptance of the updated Terms. The effective date and change history are shown on this page.


#14. Governing law and disputes

Where an institution has a subscription agreement with DevAcademia, the governing-law and dispute-resolution terms of that agreement control. Absent such an agreement, these Terms are governed by the law of the jurisdiction in which DevAcademia is established, and any dispute is subject to the courts of that jurisdiction.
